These Terms of Service govern your use of PLU Finder's website, API services, and all related services. By accessing or using our services, you agree to be bound by these terms. Please review them carefully.
1. Scope of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PLU Finder ("we," "us," or "our") governing your access to and use of the PLU Finder website, API services, and all related services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
These Terms apply to all users, including but not limited to browsers, customers, merchants, vendors, and contributors of content.
2. Acceptance and Modifications
By using our Services, you confirm that you are at least 18 years old or have reached the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.
We will make reasonable efforts to notify users of significant changes through our website or via email to registered users.
3. Description of Services
PLU Finder provides a comprehensive database of Price Look-Up (PLU) codes for produce items. Our Services include:
• Web-based PLU code lookup and search functionality • REST API access for programmatic data retrieval • MCP (Model Context Protocol) server for AI integrations • Enriched produce data including nutritional information, storage recommendations, and product descriptions • Enterprise solutions for retail and business applications
Our PLU data is sourced from official public databases including IFPS (International Federation for Produce Standards), with additional enrichment data developed by PLU Finder since May 2018.
4. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
• Use automated systems, bots, scrapers, or similar tools to access, extract, or collect data from our website without explicit written authorization • Attempt to circumvent any rate limiting, access controls, or security measures • Reproduce, duplicate, copy, sell, or exploit any portion of our Services without express written permission • Use the Services in any way that could damage, disable, or impair our infrastructure • Attempt to gain unauthorized access to any portion of the Services or any systems connected to the Services • Use the Services to transmit any malicious code, viruses, or harmful content • Interfere with or disrupt the integrity or performance of the Services • Violate any applicable local, national, or international law or regulation
Violation of these terms may result in immediate termination of access without notice and may be subject to legal action.
5. Data Sources and Accuracy
Our PLU data is derived from multiple authoritative sources:
• IFPS (International Federation for Produce Standards) - The official global administrator of PLU codes • USDA FoodData Central - Nutritional information • NYS WIC Program - Additional verification data • Additional public agricultural databases
While we strive to maintain accurate and up-to-date information by verifying data daily against IFPS, we make no warranties regarding the absolute accuracy, completeness, or reliability of any information provided through our Services. Users should independently verify critical information for business decisions.
PLU codes and their associated base data are maintained by IFPS and are in the public domain. Our enriched data (descriptions, storage tips, detailed nutritional analysis) is proprietary content developed since 2018.
6. Intellectual Property
The Services and their original content, features, and functionality are owned by PLU Finder and are protected by international copyright, trademark, and other intellectual property laws.
Public Domain Data: Base PLU codes and commodity information from IFPS are public domain and may be freely used.
Proprietary Content: Our enriched data, including but not limited to detailed descriptions, storage recommendations, proprietary nutritional analysis, product images, and database structure, are protected intellectual property. This content may not be reproduced, distributed, or used without explicit written permission.
API Access: Authorized API access grants limited license to use data according to your subscription terms. This license does not transfer ownership or grant rights beyond those explicitly stated in your service agreement.
Trademarks: "PLU Finder" and associated logos are trademarks of PLU Finder. You may not use these marks without prior written consent.
7. User-Contributed Content
If you submit, post, or provide any content to our Services (including but not limited to feedback, suggestions, corrections, or reviews), you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, and distribute such content in any medium.
You represent and warrant that: • You own or control all rights to the content you submit • The content does not violate the rights of any third party • The content is accurate and not misleading • The content complies with all applicable laws
We reserve the right to remove any user-contributed content at our sole discretion without notice.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLU FINDER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
• Loss of profits, revenue, or data • Business interruption • Cost of substitute services • Any damages arising from your use or inability to use the Services
Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
9. Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. This includes but is not limited to:
• Adding or removing features or functionality • Changing API endpoints or data formats • Modifying rate limits or access restrictions • Updating pricing for paid services
We will make reasonable efforts to provide advance notice of significant changes that may affect your use of the Services.
We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.
10. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:
• Breach of these Terms • Suspected fraudulent, abusive, or illegal activity • Non-payment of fees for paid services • Request by law enforcement or government agencies
Upon termination: • Your right to use the Services will immediately cease • Any licenses granted under these Terms will terminate • We may delete any data associated with your account
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
For users in the European Union: These Terms do not affect your statutory rights under applicable EU consumer protection laws, and disputes may be resolved in the courts of your country of residence.
For users in the United States: Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
For all other users: Disputes shall be subject to the exclusive jurisdiction of courts in the location where PLU Finder maintains its principal place of business.
Notwithstanding the above, we retain the right to seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of our intellectual property rights.
